Terms & Conditions of Service

Summit Tuning – Automotive ECU & TCU Remapping

IMPORTANT — PLEASE READ IN FULL BEFORE BOOKING: These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“the Customer”) and Summit Tuning (“the Company”). By booking, attending, or authorising any service with Summit Tuning — whether via WhatsApp, telephone, website, social media, or in person — you confirm that you have read, fully understood, and agreed to be bound by these Terms in their entirety. If you do not agree to any part of these Terms, you must not book or proceed with any service.

1 Definitions & Interpretation

In these Terms, the following definitions apply unless the context requires otherwise:

“Advanced Pre-Inspection”
means a comprehensive mechanical inspection of the Vehicle carried out by an Authorised Sub-Contractor arranged by Summit Tuning, documented on the Advanced Pre-Inspection Checklist. The Advanced Pre-Inspection is a separate service from the Summit Tuning tuning service.

“Authorised Sub-Contractor”
means an independent third-party garage or mechanical service provider arranged by Summit Tuning to carry out mechanical work or Advanced Pre-Inspections. Authorised Sub-Contractors are not employees or agents of Summit Tuning. Summit Tuning makes no representation as to their insurance status or professional accreditation.

“The Company”
means Summit Tuning, a sole trader / limited company operating under the trading name Summit Tuning, based in Birmingham, United Kingdom.

“The Customer”
means any individual, business, or organisation that books, purchases, or receives services from Summit Tuning.

“ECU”
means Engine Control Unit — the electronic system responsible for managing engine parameters including fuel delivery, ignition timing, boost pressure, and torque limiters.

“Pre-Inspection”
means the vehicle assessment and diagnostic scan carried out by Summit Tuning prior to any tuning work commencing.

“Remap / Tune”
means the process of modifying the software calibration stored within a vehicle’s ECU or TCU to alter performance, efficiency, or behaviour parameters.

“Service Date”
means the date on which Summit Tuning performed or attempted to perform a service on the Vehicle.

“Services”
means any and all automotive software tuning, diagnostics, emissions solutions, or related work performed by Summit Tuning.

“Stage 1 Remap”
means a software-only modification made without any hardware changes to the vehicle, performed within the tolerances of the vehicle’s standard hardware.

“Standard Pre-Inspection”
means the visual assessment and OBD/ECU diagnostic scan carried out by Summit Tuning prior to any tuning work commencing, as documented on the Standard Pre-Inspection Checklist.

“Stock File”
means the original, unmodified software calibration data read from the vehicle’s ECU prior to any tuning work being performed.

“TCU”
means Transmission Control Unit — the electronic system controlling automatic or dual-clutch gearbox behaviour including shift points, torque limits, and launch control.

“The Vehicle”
means the motor vehicle, van, quad bike, or other motorised equipment presented by the Customer for servicing.

“Writing”
includes communication by email, WhatsApp message, SMS, or any other documented electronic format.

2 About Summit Tuning

Summit Tuning is a professional automotive ECU and TCU remapping company based in Birmingham, United Kingdom. The Company provides services including Stage 1 remapping, gearbox tuning, vehicle diagnostics, economy tuning, emissions software solutions, pops and bangs / overrun calibration, and quad bike tuning. Summit Tuning operates both as a mobile service provider and from a fixed workshop location, as applicable at the time of booking.

Summit Tuning uses professional-grade automotive tuning equipment including AutoTuner hardware and works exclusively with dyno-developed calibration data to ensure safe, reliable, and effective results for its customers.

3 Acceptance of Terms

These Terms apply to all services provided by Summit Tuning. The Customer accepts these Terms by any of the following actions:

  • Booking an appointment via WhatsApp, telephone, website, or any other channel;
  • Attending an appointment at Summit Tuning’s workshop or mobile service location;
  • Authorising Summit Tuning to carry out work on a vehicle verbally or in writing;
  • Signing the Pre-Inspection Checklist or any other service document;
  • Making full or partial payment for any service.

No variation to these Terms shall be binding unless agreed in writing and signed by an authorised representative of Summit Tuning.

4 Eligibility & Customer Authority

4.1 Vehicle Ownership & Authority

By booking a service, the Customer confirms that they are either:

(a) the registered keeper and/or legal owner of the Vehicle, or

(b) acting with the full knowledge, consent, and written authorisation of the registered keeper or legal owner.

Where the registered keeper is under 18, the Customer confirms that appropriate consent has been obtained from a parent or legal guardian where required.

Summit Tuning accepts no liability for services carried out on a vehicle where the Customer did not have the authority to authorise such work.

4.2 Responsibility for Agreement

By booking or authorising any service, the Customer confirms that they have the authority to enter into this agreement and accept full responsibility for all obligations, payments, and consequences arising from the service.

4.3 Pre-Inspection & Agreement Confirmation

The Pre-Inspection Checklist is a mandatory part of the service and must be signed by the Customer either via the Summit Tuning Customer Portal or in physical paper form prior to any work commencing.

By signing the Pre-Inspection Checklist, the Customer confirms agreement to these Terms and acknowledges the condition of the Vehicle at the time of service.

Where the Pre-Inspection Checklist is completed and submitted via the Summit Tuning Customer Portal, the Customer’s submission constitutes a valid electronic signature for the purposes of the Electronic Communications Act 2000. By ticking all three boxes and clicking Work Approved, the Customer confirms their agreement to these Terms, acknowledgement of vehicle condition, acknowledgement of the emissions legal notice, and acknowledgement of tuning risks and liability limitations. The timestamp recorded by the portal at the point of submission is the official time of signing.

4.4 Payment Confirmation

By making payment upon completion of the service, the Customer acknowledges that the service has been carried out and that the Vehicle has been returned to them. This acknowledgement constitutes a contemporaneous record of service completion. It does not waive the Customer’s right to raise a complaint in accordance with Section 23 or to exercise any statutory rights that cannot be excluded under applicable law. However, any complaint raised following payment must be supported by independent evidence demonstrating that the issue complained of existed at the time of service completion and was not caused by subsequent use, modification, or third-party intervention.

Where payment is made solely because Summit Tuning has exercised its right to retain the Vehicle under Section 21.3 pending payment of an outstanding balance, such payment shall not constitute acceptance of service quality and does not waive the Customer’s right to raise a complaint or exercise any applicable statutory rights.

4.5 Consumer Cancellation Rights — Distance & Off-Premises Contracts

Where the Customer qualifies as a consumer and the booking is made remotely (for example via WhatsApp or telephone) or away from Summit Tuning’s fixed premises, the Customer may have a 14-day statutory cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By confirming their appointment and requesting that the service commences, the Customer expressly acknowledges that: (a) the service shall begin immediately upon their request; (b) the right to cancel is lost once the service is fully performed; and (c) the Customer remains liable for any portion of the service already performed at the point of any cancellation request made during the service. This waiver will be recorded in the booking confirmation sent to the Customer. If the Customer does not wish to waive this right, they must not confirm their appointment until the 14-day period has elapsed.

4.6 Business Customers

Where services are provided to a business customer (a Customer acting in the course of a trade, business, or profession), these Terms shall apply in full. Statutory consumer rights that apply solely to private individuals shall not apply to business customers.

5 Scope of Services

5.1 Service Availability

All services offered by Summit Tuning are subject to vehicle compatibility. Not all ECU types, software versions, vehicle makes, models, or variants can be supported. Summit Tuning will advise the Customer prior to booking if a service cannot be performed on their specific vehicle.

5.2 Service Description

Summit Tuning offers the following core services, each subject to these Terms:

  • Stage 1 ECU Remap — software-only performance or economy calibration, no hardware modifications required;
  • Gearbox / TCU Tuning — optimised shift mapping for DSG, ZF, Mercedes, Temic and other supported transmission types;
  • DPF / EGR / AdBlue Delete — emissions system software removal for off-road and motorsport use only (see Section 19);
  • Economy Tuning — fuel efficiency-focused calibration for commuter and fleet vehicles;
  • Pops & Bangs / Overrun Calibration — aggressive exhaust note and overrun behaviour maps for performance enthusiasts;
  • Launch Control — software-enabled launch control activation where supported by the vehicle platform;
  • Quad Bike / Off-Road Remapping — performance calibration for quad bikes and off-road vehicles;
  • Vehicle Diagnostics — fault code reading, identification, and clearing across all major vehicle makes.

5.3 Services Not Offered

Summit Tuning does not provide mechanical repair services, physical parts replacement, dyno testing on customer vehicles (unless expressly stated at the time of booking), or any service not listed in these Terms or on the Company’s website.

6 Booking & Appointment Procedure

6.1 Booking Process

Appointments must be booked in advance. Summit Tuning operates a first-come, first-served booking system subject to availability. A booking is confirmed only when Summit Tuning provides explicit written confirmation of the appointment date, time, location, and agreed service.

6.2 Information Required at Booking

At the time of booking, the Customer must provide accurate details including the vehicle registration number, make, model, engine size, fuel type, current mileage, and a description of any known faults or modifications. Failure to provide accurate information may result in the appointment being cancelled or the service being declined on the day.

6.3 Pricing Confirmation

All pricing is confirmed in writing prior to the service date. Summit Tuning reserves the right to amend the quoted price if, upon inspection on the day, additional complexity is identified that was not disclosed at the time of booking. The Customer will be notified of any price amendment before work commences and may cancel without charge at that point.

6.4 Appointment Punctuality

Customers are required to arrive at the agreed appointment location on time. If a Customer is more than 30 minutes late without prior notice, Summit Tuning reserves the right to reschedule the appointment and a rescheduling fee may apply.

6.5 Marketing Consent

Marketing consent is governed by Section 26.2 of these Terms.

7 Cancellation & No-Show Policy

7.1 Customer Cancellation

Customers wishing to cancel or reschedule an appointment must notify Summit Tuning at least 24 hours in advance via WhatsApp or telephone. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of up to £30 to cover administrative and scheduling costs.

7.2 No-Show Policy

Where a Customer fails to attend a confirmed appointment without prior notification, this will be recorded as a no-show. A fixed no-show fee of £50 will be charged. This fee is invoiced within 48 hours of the missed appointment and is payable within 7 days. Repeated no-shows (defined as two or more within a 12-month period) may result in future bookings being declined or a non-refundable deposit being required to secure any future appointment.

7.3 Cancellation by Summit Tuning

Summit Tuning reserves the right to cancel or reschedule an appointment at any time due to circumstances including but not limited to equipment failure, staff illness, or force majeure events. In such cases, the Customer will be notified as soon as reasonably practicable and offered an alternative appointment at no additional charge.

8 Vehicle Condition & Customer Obligations

8.1 Pre-Service Confirmation

By proceeding with a booking, the Customer warrants and confirms that:

  • The Vehicle is in a suitable mechanical and electrical condition to safely receive the requested service;
  • All known faults, dashboard warning lights, active fault codes, performance issues, unusual noises, oil or coolant leaks, or mechanical concerns have been fully and accurately disclosed to Summit Tuning prior to the service;
  • The Vehicle has not previously been remapped, had its ECU modified, or had any software written to or altered within its ECU or TCU, unless this has been expressly disclosed in writing prior to the appointment;
  • The Vehicle’s turbocharger, fuel injectors, fuel pump, clutch, and all associated drivetrain components are in good working order;
  • The Vehicle is up to date with its manufacturer-recommended servicing schedule, including oil, filters, and spark plugs where applicable;
  • The Vehicle is taxed, insured, and (where applicable) holds a valid MOT certificate;
  • The Customer has not withheld any information that may be material to the safety or outcome of the service.

8.2 Consequences of Non-Disclosure

Any failure by the Customer to disclose known faults, pre-existing conditions, or prior ECU modifications shall immediately void any entitlement to a refund, warranty, or liability claim against Summit Tuning. Summit Tuning accepts no responsibility for any damage, fault, or adverse outcome arising directly or indirectly from information withheld by the Customer.

8.3 Vehicle Servicing Recommendation

Summit Tuning strongly recommends that the Vehicle is fully serviced (including engine oil, oil filter, air filter, and fuel filter where applicable) before any remapping service is carried out. A remap applied to a poorly maintained vehicle may yield reduced results and carries a higher risk of component stress. Summit Tuning accepts no liability for outcomes on vehicles that are overdue for servicing.

9 Pre-Inspection & Diagnostic Procedure

9.1 Standard Pre-Inspection (Carried Out by Summit Tuning)

Prior to any remapping or tuning work commencing, Summit Tuning will carry out a Standard Pre-Inspection of the Vehicle. This consists of: (a) a visual check of key observable components; and (b) a full OBD/ECU diagnostic scan using professional diagnostic equipment to identify any active or stored fault codes within the vehicle’s systems. The Standard Pre-Inspection is a software and observational check only. It is not a comprehensive mechanical survey and does not constitute a guarantee of the Vehicle’s mechanical condition.

9.2 Advanced Pre-Inspection (Carried Out by Authorised Sub-Contractor)

For certain services, or where the Customer requests a more thorough vehicle assessment, Summit Tuning can arrange an Advanced Pre-Inspection to be carried out by an Authorised Sub-Contractor. The Advanced Pre-Inspection covers all major mechanical systems of the Vehicle. Summit Tuning arranges this inspection as a convenience only and does not carry out, supervise, or warrant its findings. The Authorised Sub-Contractor is independently responsible for the quality of the Advanced Pre-Inspection. Summit Tuning makes no representation as to the sub-contractor’s insurance status or professional accreditation. A separate fee applies for the Advanced Pre-Inspection, payable as directed at the time of booking. Where an Advanced Pre-Inspection is arranged, Summit Tuning completes the Standard section of the Advanced Pre-Inspection Checklist (covering visual and OBD/software elements only), and the Authorised Sub-Contractor completes and signs the mechanical sections independently. Summit Tuning’s sign-off is limited strictly to the software/observational portion.

9.3 Pre-Inspection Checklist Documents

The findings of the Standard Pre-Inspection are recorded on the Standard Pre-Inspection Checklist. Where an Advanced Pre-Inspection has been carried out, the findings are recorded on the Advanced Pre-Inspection Checklist. Both checklists are separate standalone documents which form part of this agreement by reference. The relevant checklist(s) must be signed by the Customer and the applicable technician or sub-contractor before any tuning work proceeds.

9.4 Faults Identified During Pre-Inspection

If the Pre-Inspection reveals active fault codes, mechanical concerns, or conditions that make it inadvisable to proceed with the tuning service, Summit Tuning will notify the Customer immediately. In such cases, the Customer may: (a) elect to have the underlying faults rectified elsewhere and rebook, or (b) instruct Summit Tuning to proceed at the Customer’s own risk, in which case Summit Tuning accepts no liability for any adverse outcome. Where a Customer instructs Summit Tuning to proceed with a service despite faults or concerns identified during the Pre-Inspection, this instruction must be given in writing, either via the Customer Portal notes field or by WhatsApp message, before any work commences. Summit Tuning will not proceed on a verbal instruction alone in such circumstances, and the written record forms part of the service agreement. A diagnostic fee may be charged regardless of whether the service proceeds.

9.5 Diagnostic Fee

Where a Standard Pre-Inspection has been carried out and the Customer elects not to proceed with the service — whether because faults have been identified or for any other reason — a fixed diagnostic fee of £50 will be charged. This fee is non-refundable as it covers the time, equipment, and overhead costs of the technician carrying out the inspection. The fee is payable immediately upon the Customer’s decision not to proceed and before the Vehicle is released. This applies regardless of whether the decision not to proceed is made by the Customer or results from the condition of the Vehicle as identified during the Pre-Inspection, except where Summit Tuning cancels the service of its own accord under Section 7.3, in which case no diagnostic fee will be charged.

10 Right to Refuse Service

Summit Tuning reserves the right to refuse, suspend, or terminate any service at its sole discretion, including but not limited to the following circumstances:

  • The Vehicle is deemed mechanically or electrically unsuitable for tuning;
  • The Customer has provided false, inaccurate, or misleading information;
  • The Customer behaves in an aggressive, abusive, or threatening manner towards Summit Tuning staff;
  • The requested service would, in the professional judgement of Summit Tuning, pose an unacceptable risk to the Vehicle, the Customer, or third parties;
  • The Customer is unable or unwilling to provide proof of age, vehicle ownership, or any other required documentation;
  • Payment cannot be confirmed or is refused.

Where service is refused before work has commenced, any diagnostic fee already incurred will remain payable. No refund of any other payment will be due in circumstances where refusal results from the Customer’s own conduct or misrepresentation.

11 ECU Software & Stock File Management

11.1 Stock File Backup

Before any modification is written to the Vehicle’s ECU or TCU, Summit Tuning will read and securely store a complete copy of the original (stock) software calibration file. This file is the baseline to which the vehicle can be returned in the event of a reversion request.

11.2 Stock File Retention

Summit Tuning will retain the Customer’s original stock file for a minimum period of 12 months from the Service Date. After this period, Summit Tuning reserves the right to delete archived files. Customers who wish to retain access to their stock file beyond this period should request a copy in writing within the 12-month window, subject to Section 13 (Intellectual Property).

11.3 File Corruption or Loss

In the extremely rare event that a stock file cannot be successfully read, saved, or verified prior to writing a new calibration, Summit Tuning will notify the Customer immediately and will not proceed until an alternative solution is agreed. Summit Tuning shall not be held liable for any pre-existing ECU corruption that prevents a successful read.

11.4 Modified File Ownership

The modified tune file written to the Customer’s ECU is the intellectual property of Summit Tuning and/or its licensed tune suppliers. Customers do not acquire ownership or rights to copy, transfer, or reproduce the modified calibration file. See Section 13 for full details.

12 Third-Party Software & Tune Files

Summit Tuning works with a network of professional tune file developers whose calibrations are derived from dyno-developed data. In some cases, the calibration file applied to a Customer’s vehicle may originate from a third-party supplier.

Regardless of the origin of the calibration file, Summit Tuning remains the Customer’s sole point of contact and accepts full responsibility for the service delivered. Where a software-related issue is identified following the service, Summit Tuning will investigate and liaise directly with its suppliers on the Customer’s behalf, which may include requesting a revised calibration file or reverting the Vehicle to stock in accordance with Section 22.

12A Authorised Sub-Contractor Services

12A.1 Scope

This section governs all mechanical or physical work arranged by Summit Tuning and carried out by an Authorised Sub-Contractor, including but not limited to physical DPF gutting, EGR removal, and any other mechanical preparation required before a software service can be applied. Summit Tuning is a software tuning specialist only and does not itself carry out any physical mechanical work on vehicles. Summit Tuning’s involvement in the Advanced Pre-Inspection is limited to the Standard section of the checklist, as described in Section 9.2.

12A.2 Independent Contractor Status

Authorised Sub-Contractors are independent third parties and are not employees, agents, or representatives of Summit Tuning. Summit Tuning does not control the manner in which sub-contractors perform their work. Summit Tuning makes no representation as to the sub-contractor’s insurance status or professional accreditation and the Customer engages with sub-contractor services on that basis.

12A.3 Liability for Sub-Contractor Work

Summit Tuning accepts no liability whatsoever for the quality, outcome, safety, or consequences of any mechanical or physical work carried out by an Authorised Sub-Contractor. Where the Customer has a complaint or claim relating to mechanical work carried out by a sub-contractor, the Customer must direct that complaint to the sub-contractor directly. Summit Tuning may, at its discretion, assist in facilitating communication between the Customer and the sub-contractor but is under no obligation to do so.

12A.4 Invoicing

Summit Tuning will, upon request, provide the Customer with a separate itemised invoice covering only the software tuning element of the service. Where mechanical work has been arranged via an Authorised Sub-Contractor, that element will be invoiced separately by the sub-contractor directly, and the Customer’s contract for that work is solely with the sub-contractor. Summit Tuning does not invoice for mechanical work performed by sub-contractors.

12B Same-Day Service Issues and ECU Errors

If a fault arises during or immediately following the tuning process that is directly attributable to the service performed — including but not limited to ECU write errors, corrupted flash, communication failure during programming, or drivability issues arising on the day — Summit Tuning accepts full responsibility for rectifying that fault at no cost to the Customer. This includes restoring the ECU to stock using the retained stock file where necessary. Summit Tuning will make reasonable efforts to resolve same-day issues before the Customer leaves. If resolution is not possible on the day, Summit Tuning will arrange a follow-up appointment at no charge and will not release a vehicle in a state known to be worse than when it arrived without the Customer’s informed written consent. This section applies only to faults directly caused by the service, not pre-existing conditions identified during the Pre-Inspection.

13 Intellectual Property

13.1 Ownership of Tune Files

All modified calibration files, tune data, maps, and software produced or applied by Summit Tuning remain the exclusive intellectual property of Summit Tuning and/or its licensed tune suppliers at all times. No transfer of intellectual property rights to the Customer is implied or granted by the provision of a tuning service.

13.2 Prohibited Uses

The Customer shall not: (a) copy, extract, reverse engineer, decompile, or distribute any modified calibration file; (b) provide the modified file to any third party; (c) use any modified file on any vehicle other than the Vehicle for which it was specifically developed.

13.3 Customer’s Original File

The original stock ECU file read from the Customer’s vehicle remains the property of the original vehicle manufacturer. Summit Tuning holds this file solely for the purposes of backup and potential reversion and does not claim ownership of it.

14 Mechanical & Electrical Component Liability

14.1 General Exclusion

Subject to Section 24.3, and without affecting Summit Tuning’s liability for damage proven to result directly from its own failure to exercise reasonable care and skill in performing the software tuning service, Summit Tuning expressly excludes all liability for the failure, damage, or deterioration of any mechanical or electrical component following the provision of any service. This exclusion applies whether the failure occurs immediately after or at any time subsequent to the service, and regardless of whether the failure could be considered connected to the tuning work performed. Nothing in this section affects the Customer’s rights under the Consumer Rights Act 2015, including the right to a service performed with reasonable care and skill.

14.2 Specific Component Exclusions

Without limiting the generality of Section 14.1, Summit Tuning accepts no liability for failure of or damage to any of the following:

  • Engine internals including pistons, connecting rods, crankshaft, cylinder head, head gasket, camshaft, or valvetrain components;
  • Turbochargers, superchargers, intercoolers, wastegates, or blow-off valves;
  • Fuel injectors, high-pressure fuel pumps, fuel pressure regulators, or common rail systems;
  • Clutch assemblies, dual-mass flywheels, pressure plates, or release bearings;
  • Gearboxes, differentials, driveshafts, or CV joints;
  • Exhaust systems, catalytic converters, DPF units, or EGR valves;
  • Cooling systems, radiators, thermostats, or water pumps;
  • Battery, alternator, starter motor, or any ancillary electrical component;
  • Sensors, actuators, solenoids, or any other electronic module.

14.3 Pre-Existing Wear

Summit Tuning acknowledges that remapping may place increased demands on vehicle components. The Customer accepts that components which are approaching the end of their serviceable life may be more susceptible to failure under increased load. Summit Tuning’s Pre-Inspection is designed to identify obvious concerns but is not a comprehensive mechanical survey and does not constitute a guarantee of component condition.

Summit Tuning always operates within manufacturer-specified mechanical tolerances. Stage 1 remaps are specifically designed to work safely with standard factory hardware in good condition.

15 Performance Claims & Estimates

15.1 Nature of Estimates

Any performance figures, power gains, torque improvements, fuel economy improvements, or other estimates provided by Summit Tuning — whether verbally, via WhatsApp, on the website, in marketing materials, or on social media — are provided in good faith as general estimates based on typical results for the relevant vehicle platform. They do not constitute a guarantee or warranty of specific outcomes. Any figures, estimates, or indicative gains communicated informally — including via WhatsApp, SMS, social media messages, verbal discussion, or any other informal channel — by any representative of Summit Tuning are subject to the same limitations as formal estimates and do not constitute a guarantee or contractual representation.

15.2 Variables Affecting Results

Actual results may vary materially based on a wide range of factors including but not limited to:

  • The overall mechanical condition and maintenance history of the Vehicle;
  • The current mileage and component wear of the Vehicle;
  • Fuel quality, octane rating, and the fuel brand used;
  • Ambient temperature, altitude, and atmospheric conditions at the time of testing;
  • Individual driving style, load conditions, and usage patterns;
  • The specific ECU hardware variant and software version present on the Vehicle;
  • Any pre-existing restrictions or modifications to the Vehicle’s hardware.

15.3 No Liability for Shortfall

Summit Tuning shall not be held liable where actual performance gains fall short of estimated figures, provided the service was carried out competently and in accordance with these Terms. The Customer’s sole remedy in cases of dissatisfaction with results is the reversion procedure described in Section 22.

16 Fuel Requirements

Summit Tuning may specify a minimum fuel octane rating or fuel type appropriate for the calibration applied to the Vehicle. Where a minimum fuel specification is advised, the Customer is responsible for ensuring the Vehicle is fuelled accordingly at all times following the remap. Use of lower-grade fuel than specified may cause engine knock, damage, or reduced performance, for which Summit Tuning accepts no liability.

Customers are advised to use reputable, branded fuels and to avoid supermarket fuels of uncertain quality where possible, particularly following a Stage 1 remap on a turbocharged engine.

17 Manufacturer Warranty

Summit Tuning accepts no responsibility whatsoever for any warranty implications — including partial or full warranty voidance — arising from services performed. Customers are strongly advised to consult their vehicle manufacturer, authorised dealer, and any relevant warranty provider before booking a tuning service.

The Customer is solely responsible for any disclosure obligations to their manufacturer, dealer, or warranty provider arising from services performed.

18 Insurance Obligations

Vehicle modifications, including ECU remapping, may constitute a material modification that must be declared to the Customer’s motor insurer. Failure to notify an insurer of a material modification may invalidate the Customer’s motor insurance policy, which could expose the Customer to significant financial and legal liability.

Summit Tuning strongly advises all Customers to contact their motor insurer before or immediately after having their Vehicle remapped. Summit Tuning accepts no responsibility for any consequences arising from the Customer’s failure to notify their insurer of any modification carried out by Summit Tuning.

19 Emissions Modifications (DPF / EGR / AdBlue)

19.1 Off-Road & Motorsport Use Only

All emissions modification services offered by Summit Tuning — including DPF delete, EGR delete, and AdBlue/SCR delete — are provided strictly and exclusively for use in vehicles that will not be operated on public roads. These services are intended solely for off-road use, track use, closed-course motorsport, agricultural vehicles, or vehicles used on private land.

19.2 Customer Declaration

By requesting any emissions modification service, the Customer irrevocably declares in writing that: (a) the Vehicle will not be used on public roads following the modification; (b) the Customer accepts full and sole legal responsibility for ensuring compliance with all applicable UK road traffic, vehicle construction, and emissions legislation; and (c) the Customer indemnifies Summit Tuning in full against any legal action, fine, prosecution, or claim arising from the use of an emissions-modified vehicle on a public road.

19.3 No Refund on Emissions Services

Due to the nature of emissions modification services, no refund will be offered once the work has been completed, except where there is a proven error in the service performed by Summit Tuning.

20 MOT & Road Legality

A standard Stage 1 ECU remap does not alter emissions output in a manner that would cause a vehicle to fail the standard UK MOT emissions test, provided the vehicle is otherwise in good mechanical condition. However, Summit Tuning makes no guarantee regarding MOT outcomes, as results depend on many factors beyond the control of the Company.

Any service that involves modification of emissions-related hardware or software beyond a standard Stage 1 remap (including pops and bangs maps, DPF deletes, EGR deletes, or AdBlue solutions) may have implications for the vehicle’s road legality and MOT compliance. The Customer is solely responsible for understanding and ensuring compliance with current UK MOT standards and road vehicle regulations.

21 Payment Terms

21.1 Pricing

All prices are confirmed in writing prior to work commencing and are inclusive of VAT where applicable. Summit Tuning’s standard pricing is published on the Company’s website at summittuning.co.uk and is subject to change without notice. The price applicable to a specific booking is the price confirmed in writing at the time the booking is accepted.

21.2 Payment Method

Payment is due in full upon completion of the service. Summit Tuning accepts payment by cash, credit card, debit card, and contactless payment. Payment by bank transfer must be agreed in advance and funds must be confirmed before the Vehicle is released. Summit Tuning does not currently accept payment by cheque.

21.3 Non-Payment

Where a Customer refuses or is unable to make payment upon completion of a service, Summit Tuning asserts a possessory lien over the Vehicle in respect of unpaid sums arising solely from the service performed on that Vehicle on the relevant Service Date. The lien does not extend to any other debt or obligation. The vehicle will be released promptly upon confirmed receipt of the outstanding balance. Summit Tuning also reserves the right to pursue the outstanding balance through a debt recovery process and charge interest on overdue amounts at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

21.4 Deposits

Summit Tuning may, at its discretion, request a deposit to secure a booking for bespoke, complex, or high-value services. Deposits are non-refundable except where the service is cancelled by Summit Tuning.

22 Refund & Reversion Policy

22.1 Reversion to Stock

If the Customer is dissatisfied with the results of a remap service, Summit Tuning will, upon request made within 14 calendar days of the Service Date, restore the Vehicle’s ECU to the original stock software free of charge. The Vehicle must be returned to Summit Tuning at the Customer’s expense in the same mechanical condition as at the time of the service.

22.2 Eligibility for Refund

Following a successful reversion to stock software, a partial refund may be considered by Summit Tuning at its discretion, subject to the following conditions being met in full:

  • The reversion request is made within 14 calendar days of the Service Date;
  • The Vehicle has not been modified, re-tuned, or had its ECU or TCU accessed by any third party since the original service;
  • Summit Tuning may request reasonable supporting evidence where the nature of the complaint requires it, which may include an independent inspection report obtained at the Customer’s cost, to demonstrate that any failure or adverse outcome occurred as a direct result of the tuning service and not from pre-existing wear, undisclosed faults, or factors unrelated to the calibration applied;
  • All information provided by the Customer at the time of booking was accurate, complete, and not misleading in any respect.
  • Summit Tuning reserves the right to inspect the Vehicle independently before any refund decision is made. The Customer must make the Vehicle available for such inspection within 7 days of Summit Tuning’s written request, at a location agreed between the parties.

For the avoidance of doubt, dissatisfaction with the degree of performance improvement alone — where the service was competently performed — shall not constitute grounds for a refund.

22.3 Refund Deductions

Any refund issued will be subject to deduction of: (a) all labour costs associated with the original service; (b) the diagnostic scan fee; (c) any third-party software licensing costs incurred by Summit Tuning in connection with the service; and (d) any costs associated with the reversion procedure. The maximum refund amount will therefore not exceed the difference between the total amount paid and the sum of these deductions.

22.4 Non-Refundable Services

The following services are non-refundable once completed: DPF delete (software element), EGR delete (software element), AdBlue/SCR delete, and diagnostic scan fees. Pops and bangs / overrun calibration fees are non-refundable where the service has been competently performed, but this does not affect the Customer’s right to reversion or remedy where Summit Tuning has failed to exercise reasonable care and skill in performing the service.

22.5 This Policy Does Not Affect Statutory Rights

Nothing in this Section 22 affects the Customer’s statutory rights under the Consumer Rights Act 2015, including but not limited to the right to repeat performance or a price reduction where a service has not been carried out with reasonable care and skill.

23 Complaints Procedure

23.1 Informal Resolution

In the first instance, any Customer with a complaint is requested to contact Summit Tuning directly via email at info@summittuning.co.uk or via WhatsApp on +44 7457 410358. Summit Tuning will acknowledge all complaints within 2 working days and aim to provide a full response within 5 working days.

23.2 Escalation

Where a complaint cannot be resolved informally within 14 days, the Customer may refer the matter to an independent automotive dispute resolution provider. Summit Tuning will co-operate fully with any such process.

23.3 Legal Action

Legal proceedings should be considered only as a last resort once the complaints procedure above has been exhausted. Summit Tuning reserves the right to recover reasonable legal costs in any proceedings where a claim is found to be wholly without merit.

24 Limitation of Liability

24.1 Maximum Liability

To the maximum extent permitted by applicable law, Summit Tuning’s total aggregate liability to the Customer — whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total amount paid by the Customer for the specific service giving rise to the claim.

24.2 Excluded Losses

Summit Tuning shall not be liable to the Customer for any: (a) loss of profit; (b) loss of revenue; (c) loss of use of the Vehicle; (d) loss of business or contracts; (e) indirect, special, or consequential losses of any kind; (f) losses arising from third-party claims; (g) costs of alternative transport; or (h) any other economic loss, whether or not foreseeable and whether or not Summit Tuning has been advised of the possibility of such loss.

24.3 Death & Personal Injury

Nothing in these Terms shall limit or exclude Summit Tuning’s liability for death or personal injury caused by the Company’s negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Nothing in these Terms excludes liability for loss or damage arising from proven negligence.

25 Indemnification

The Customer agrees to indemnify, defend, and hold harmless Summit Tuning, its employees, contractors, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or in connection with: (a) the Customer’s breach of any provision of these Terms; (b) the Customer’s misrepresentation or non-disclosure of material information; (c) the Customer’s use of the Vehicle following the service, including any use of an emissions-modified vehicle on a public road; or (d) any third-party claim arising from the Customer’s actions or omissions.

26 Photography, Video & Marketing

26.1 Internal Documentation

Summit Tuning reserves the right to photograph and/or video the Vehicle before, during, and after the service for internal quality control, record-keeping, and evidential purposes. These materials may be retained securely alongside the Customer’s service record.

26.2 Marketing Use

Summit Tuning may use photographs, videos, performance data, or anonymised vehicle details for marketing purposes including on the Company’s website, social media accounts, and promotional materials, only where the Customer has given documented written consent. Consent is obtained exclusively via a checkbox on the Standard Pre-Inspection Checklist or booking confirmation form. Verbal consent alone is not sufficient for this purpose. Consent is entirely optional and will not affect the provision of services. The Customer may withdraw consent at any time by contacting Summit Tuning in writing at info@summittuning.co.uk. Withdrawal will not affect any use made prior to the date of withdrawal. For the avoidance of doubt, no marketing consent is collected or recorded at any other point in the booking or service process.

26.3 Vehicle Registration & Identity

Summit Tuning will not publish any image in which the Vehicle’s full registration plate is clearly legible without the Customer’s prior consent.

27 Data Protection & GDPR

27.1 Data Collected

Summit Tuning collects and processes personal data including the Customer’s full name, contact telephone number, email address, vehicle registration number, and service history. This data is collected for the purposes of delivering services, maintaining customer records, communicating with the Customer about their service, and (with consent) marketing.

27.2 Legal Basis for Processing

Summit Tuning processes personal data on the legal bases of: (a) contractual necessity — to fulfil the services requested; (b) legitimate interests — to maintain business records and ensure service quality; and (c) consent — for marketing communications.

27.3 Data Security

All personal data held by Summit Tuning is stored securely and access is restricted to authorised personnel only. Summit Tuning will not sell, transfer, or disclose personal data to third parties except where required by law or where necessary to deliver the service (for example, sharing data with a tune file supplier for the purposes of developing a custom calibration).

27.4 Customer Rights

Under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, Customers have the right to: access the personal data held about them; request correction of inaccurate data; request erasure of their data (subject to legal retention obligations); object to processing; and withdraw consent for marketing at any time. To exercise any of these rights, Customers should contact info@summittuning.co.uk.

27.5 Retention Period

Summit Tuning will retain customer personal data for a period of 6 years from the date of the last service, in accordance with standard business record-keeping requirements. After this period, data will be securely deleted unless there is an ongoing legal obligation to retain it.

27.6 Full Privacy Policy

28 Customer Portal

Summit Tuning operates a Customer Portal accessible at guest.summittuning.co.uk. By registering for and using the Customer Portal, the Customer agrees to maintain the confidentiality of their login credentials and to notify Summit Tuning immediately of any suspected unauthorised access to their account.

Summit Tuning reserves the right to suspend or terminate portal access where misuse, unauthorised activity, or a breach of these Terms is suspected. Data stored within the Customer Portal is subject to the data protection provisions of Section 27.

29 Force Majeure

Summit Tuning shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the Company’s reasonable control, including but not limited to acts of God, pandemic, flood, fire, civil unrest, government restrictions, equipment failure caused by third-party supply chain issues, or any other event that could not reasonably have been anticipated or prevented. In such circumstances, Summit Tuning will notify the Customer as soon as practicable and will endeavour to reschedule the affected service at the earliest opportunity.

30 Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable to any extent, that provision shall be severed from the remainder of the Terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.

31 Entire Agreement

These Terms, together with any written booking confirmation and the signed Pre-Inspection Checklist, constitute the entire agreement between Summit Tuning and the Customer in relation to the services provided and supersede all prior representations, agreements, negotiations, and understandings between the parties, whether oral or written.

32 Amendments to These Terms

Summit Tuning reserves the right to update, amend, or replace these Terms at any time. The current version will always be published at summittuning.co.uk/terms-and-conditions and will display the effective date. Bookings made after the publication of revised Terms will be governed by the revised version. Where a booking is already confirmed at the time of amendment, the Terms in force at the time of that booking confirmation shall apply.

33 Governing Law & Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

For consumer customers, nothing in this clause prevents the Customer from bringing proceedings in any court of competent jurisdiction applicable to their place of residence, where that right exists under applicable law.
